As given in the Code of Criminal Procedure, 1972 <\/a>recording of statement is made under section 162 where the police officer records the statement and under section 164 Crpc the statement is recorded by the magistrate.<\/p>\n\n\n\n

What is section 164 of the Code of\u00a0Criminal Procedure 1972<\/a>?\u00a0\u00a0<\/h3>\n\n\n\n

The section 164 of the Crpc <\/a>says about the statement which are being recorded by the Magistrate:<\/p>\n\n\n\n

Any judicial magistrate or any metropolitan magistrate whether he is having the jurisdiction or not in the case can record any statement or any such confession, made before him in course of  an investigation under this law or at any time before commencement of the inquiry or trail, also provided in this section no police officer shall record any such statement or confession on whom any of such power is conferred.<\/p>\n\n\n\n

Magistrate before recording such a statement or confession <\/a>explains the person who is making such confession explains the person who is making such confession that if he\/she is not bound to make a confession, and if he does then the confession may be used as the evidence against him. Before confession is recorded the person who is appearing before the magistrate and states that he is not willing to make any confession the magistrate shall not authorise any detention of such person.<\/p>\n\n\n\n
