Don\u2019t wait to \u201cinvestigate\u201d it yourself, take action.<\/li>\n\n\n\n<li><strong>Quick Tip: <\/strong>Call your bank\u2019s emergency helpline right away and document the date\/time of the call.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Step 2: Screenshot Everything. It\u2019s Your Legal Ammo<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>My mistake: <\/strong>I deleted the fake job message in a panic. But, somehow I had a screenshot in my gallery.<\/li>\n\n\n\n<li><strong>What to do: <\/strong>Keep screenshots of messages, emails, payment confirmations, phone numbers, and links. These are admissible as evidence under Section 65B of the Indian Evidence Act, 1872, provided they are certified.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Step 3: Report It Online. It\u2019s Fast, Free, and Official<\/h4>\n\n\n\n<p>I went to www.cybercrime.gov.in, the national cybercrime reporting portal of India.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Choose &#8220;Report Other Cyber Crime&#8221;<\/li>\n\n\n\n<li>Fill in your details and upload evidence<\/li>\n\n\n\n<li>Submit and keep the complaint ID safe<\/li>\n<\/ul>\n\n\n\n<p><strong>Why this matters: <\/strong>Your case goes directly to the local police cyber cell from here. You\u2019ve created a digital record of your complaint, which is crucial.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Step 4: File an FIR, Even If the Fraud Happened Online<\/h4>\n\n\n\n<p><strong>Truth: <\/strong>I was hesitant. FIRs felt intimidating. But I walked into my local police station and said, \u201cI want to file a <strong><a href=\"https:\/\/www.leadindia.law\/legal-services\/criminal\/statutory-provisions-and-tips-to-protection-from-cyber-fraud\">cyber fraud<\/a><\/strong> complaint.\u201d<\/p>\n\n\n\n<p>They guided me to the cybercrime cell, and I filed an FIR under:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Section 420 IPC\/Section 318 (4) BNS: <\/strong>Cheating<\/li>\n\n\n\n<li><strong>Section 66C &amp; Section 66D of the IT Act: <\/strong>Identity theft and impersonation<\/li>\n<\/ul>\n\n\n\n<p><strong>Legal tip: <\/strong>Due to the Zero FIR rule, you can file a cybercrime FIR at any police station, even if the fraud happened in another city or state.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Step 5: Don\u2019t Just Call Your Bank, Write to Them<\/h4>\n\n\n\n<p><strong>What I learned: <\/strong>Phone calls aren\u2019t enough. You must file a written complaint with your bank or send them an email.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Under RBI\u2019s 2017 circular:<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If you report within 3 days, your liability becomes zero<\/li>\n\n\n\n<li>Banks must respond within 90 days<\/li>\n<\/ul>\n\n\n\n<p>I wrote to my bank\u2019s grievance redressal officer and attached my police complaint and cybercrime report.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Step 6: Still No Response? Go to the RBI\u2019s Ombudsman<\/h4>\n\n\n\n<p>It was more than a month before I received my refund.&nbsp; I thus went to the Banking Ombudsman&#8217;s website at www.cms.rbi.org.in&nbsp; and lodged a complaint.<\/p>\n\n\n\n<p>My complaint was acknowledged within 7 days. The bank refunded the money in 15 days after that.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Step 7: Legal Options If You Want Compensation<\/h4>\n\n\n\n<p>If your losses are significant, you can:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>File a case with the Adjudicating Officer under the IT Act, 2000 (for losses up to \u20b95 crore)<\/li>\n\n\n\n<li>Approach a Consumer Forum if the bank failed in service or due diligence<\/li>\n\n\n\n<li>File a civil suit for damages if your identity or reputation was affected<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">What the Law Says: Sections That Protect You<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Section 420 of the Indian Penal Code (IPC)\/<a href=\"https:\/\/www.leadindia.law\/bns-section-318-cheating\">Section 318 (4) of the Bhartiya Nyaya Sanhita<\/a>: <\/strong>Deals with cheating and dishonestly inducing delivery of property.
