Sneha Ahuja<\/strong>, the Supreme Court ruled that the protection of a woman&#8217;s right to reside is broad and any eviction must be justified by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, courts often provide quick relief to women by granting them residence and protection orders, particularly when there have been allegations of harassment or family law disputes.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Rights of Daughters in Family Property<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">There is a common belief that daughters lose rights in the parental house after marriage; this belief is legally incorrect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance to Hindu Succession Act 1956 (as amended in 2005) daughters are equal coparceners and should be allowed to inherit property through their father on an equal basis as male children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of <strong>Vineeta Sharma vs Rakesh Sharma,<\/strong> the Supreme Court ruled that daughters are entitled to an equal share from birth regardless of the time when their father died.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that if at all the property is ancestral, the daughter:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Has a legal share in the property<\/li>\n\n\n\n<li>Cannot be forcibly evicted<\/li>\n\n\n\n<li>Can claim partition through court<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Rights of Parents and Senior Citizens<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The senior citizens often face harassment from their own children, including the attempts to take control of the property or force them out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Maintenance and Welfare of Parents &amp; Senior Citizens Act, 2007<\/strong> mostly provides strong protection to the parents.
