Article 21 of Indian Constitution prohibits encroachment of life as well as personal liberty, and Article 22 counters unlawful arrests. In the case of Jaskaran Jeet Singh Deol v. Additionally, the arrested person should have the right to consult the legal practitioner of their choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has consistently held that informing arrested persons of the reasons for their arrest should be meaningful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Jaskaran Jeet Singh Deol, the Court reaffirmed that the grounds of arrest must be provided <strong>in writing and in a language understood by the arrested person<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not merely to tell the person that they have been arrested. The person must know the basic facts and reasons forming the basis of the arrest so that they can effectively consult their lawyer, oppose police custody and seek appropriate legal remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the present criminal procedure framework, Section 47 of <strong><a href=\"https:\/\/www.leadindia.law\/bharatiya-nagarik-suraksha-sanhita\">Bharatiya Nagarik Suraksha Sanhita of 2023 (BNSS)<\/a><\/strong> corresponds to statutory requirements concerning the communication of grounds of arrest.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Does Article 22(2) Protect?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 22(2) provides for any other important safeguard:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any person who has been arrested and is taken into custody must be brought before Magistrate as soon as possible or within 24 hours of arrest, but without including time that it takes to travel from place of arrest to Magistrate&#8217;s court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is done to prevent the police from having unlimited power over the person under arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judicial scrutiny must take place within the constitutionally prescribed period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/www.leadindia.law\/bharatiya-nyaya-sanhita\/bns-section-58-concealing-design-to-commit-offence-punishable-with-death-or-imprisonment-for-life\">Section 58 of the BNSS<\/a><\/strong> also contains the statutory requirement concerning production of an arrested person before a Magistrate within 24 hours.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in Jaskaran Jeet Singh Deol reiterated that detention beyond this constitutional period without the Magistrate&#8217;s authority is illegal.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Facts of Jaskaran Jeet Singh Deol v. State of Punjab<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">This case stems from an FIR lodged under the <strong><a href=\"https:\/\/www.leadindia.law\/bharatiya-nyaya-sanhita\">Bharatiya Nyaya Sanhita, 2023<\/a><\/strong> and the Protection of Children from Sexual Offences Act, 2012 at Mataur Police Station, Punjab.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FIR contained the charges of sexual offences against any minor.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The accused was then apprehended on May 17, 2026 at about 7:54 A.M. He was produced before a magistrate on May 18, 2026 around noon.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Magistrate noticed two significant issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First, written grounds of arrest had not been furnished to the appellant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Second, the appellant had been produced before the Magistrate after more than 24 hours from the time of arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Magistrate consequently directed his release because the arrest was rendered illegal by the non-compliance with the constitutional and statutory requirements relating to the grounds of arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigating agency subsequently sought custody again. The Supreme Court summarized the legal position by stating that the reasons for arrest must be made known in writing, in a language that is understood by the accused.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reasons are to be communicated to the accused at the earliest possible opportunity. It can be seen that the requirement is not just a matter of procedure.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important for the person arrested to know the reasons for the arrest because only by knowing that could the person challenge the arrest in a suitable manner or consult with counsel and oppose the application of police custody.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Happens When a Person is not Produced Within 24 Hours?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The 24-hour requirement as per Article 22(2) is intended to prevent the prolonged police detention without judicial oversight.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Jaskaran Jeet Singh Deol, the Supreme Court relied upon earlier decisions and reiterated that continued detention beyond 24 hours without production before the Magistrate is unconstitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court observed that once the constitutional requirement is violated, the detention becomes unlawful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling also acknowledged that, depending on the circumstances, constitutional courts can deem compensation as a public law remedy for an infringement of Article 22(2), thus not hindering the affected party from seeking other remedies.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Can a Person Be Re-Arrested After an Illegal Arrest?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These were the central questions before the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court did not hold that each and every person whose arrest is declared illegal can never get arrested again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, it drew the distinction between:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Release from unconstitutional custody; and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 A subsequent lawful arrest based on valid legal grounds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigating agency may still require custody for legitimate investigative purposes. The Court therefore strengthened the requirement of judicial oversight.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Role of the Magistrate in Re-Arrest<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court directed that where an accused has been released because written grounds of arrest were not furnished and the investigating agency still requires custodial interrogation, an application must be made before the concerned Magistrate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The application must contain:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 The grounds of arrest;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Reasons for requiring custody;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 The necessity for re-arrest;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 An explanation for why the grounds of arrest were not furnished initially; and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Endorsement of the immediate superior authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Magistrate must consider the application expeditiously while adhering to principles of natural justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, the decision places judicial scrutiny between the earlier unconstitutional arrest and any proposed subsequent custodial action.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Responsibility of Police Officers<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment also emphasises institutional accountability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court ordered that if a person charged with a crime is discharged due to a breach of Article 22(1), the probe must be transferred to a different officer and a departmental inquiry launched for noticeable negligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should such inquiry lead to a negative result, then the officer responsible may face the appropriate disciplinary actions, including an entry in the record of service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And this point is crucial because it is not possible that constitutional protection can be effective without the ability to punish offenders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Relationship Between Article 21 and Article 22<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Articles 21 and 22 work effectively in tandem when an individual is arrested.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whereas Article 21 guarantees the right to life and liberty, Article 22 provides constitutional protections when that liberty is suspended due to an arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has treated infringement of Article 22 as a serious violation of the right to liberty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court has also observed that the seriousness of the crime does not allow for the violation of constitutional safeguards, since while the nature of the accusation is important for police investigation and bail under criminal law, it does not do away with the constitutional requirements concerning arrests and detentions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, even in serious criminal cases, the police and other authorities remain bound by the Constitution.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Practical Rights of a Person at the Time of Arrest<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">A person who is arrested should be aware of the following basic safeguards:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ask for the grounds of arrest.<\/li>\n\n\n\n<li>Ensure that the written grounds of arrest are furnished.<\/li>\n\n\n\n<li>Request communication with a lawyer.<\/li>\n\n\n\n<li>Keep a record of the time and place of arrest, where possible.<\/li>\n\n\n\n<li>Ensure that the person is produced before the Magistrate within the constitutionally prescribed period.<\/li>\n\n\n\n<li>Inform the Magistrate if written grounds of arrest have not been supplied.<\/li>\n\n\n\n<li>Preserve copies of arrest-related documents and remand orders.<\/li>\n\n\n\n<li>Inform the court about any alleged violation of constitutional safeguards.<\/li>\n\n\n\n<li>Seek appropriate legal remedies where the arrest or detention is unlawful.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Family members should also try to preserve relevant documents, notices, medical records and communications concerning the arrest.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusion<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">According to the ruling in Jaskaran Jeet Singh Deol v.
