Sometimes people want to perform their marriage registration & court marriage in Mumbai.  Article 19 of the Indian Constitution allows us to choose & marry someone we love. Still, it is not seen as a good thing in many places in India. There are two important procedures for partner’s marriage in Mumbai.

The important laws for the marriage of partners in Mumbai – 

  1. Special Marriage Act, 1954 – Both the partners can perform their court marriage in India, irrespective of religion, caste, or sections. As per this act, parents’ consent is important. It takes at least 30 days for the completion of the marriage. 
  2. Hindu Marriage Act, 1955 – All Hindus including Sikhs, Jains & Buddhists can easily marry their partner & register their marriage under this act. Parents Consent is not mandatory but, witnesses are required. 
  3. Muslim Personal Laws – All Muslims can perform their marriage / Nikah & their marriage will be registered under these laws. Qazi will provide a Nikah-Nama after their marriage.
  4. Indian Christian Marriage Act, 1872  – All Christians can perform their Church marriage with the help of a priest. After their marriage, they have to register the marriage under this act.

The Procedure For Marriage Registration & Court Marriage In Mumbai – 

Method 1: Court Marriage ( By Special Marriage Act, 1954 )

  1. They have to send a letter/notice to the marriage officer of the district regarding their intended marriage.
  2. This letter must be sent 30 days before the intended marriage.
  3. The marriage registrar will put the letter on the notice board.
  4. The time period for objection is 30 days. Anyone can object to the marriage during the 30 days. 
  5. The investigating officer will review the objections to the marriages. 
  6. After checking the validity of the objections, anyone can easily perform their marriage.

Method 2: Marriage Registration ( By Personal Laws ) 

  1. Conversion ( in the case of different religions ) – If both the partners belong to different religions they have to perform the conversion process before their marriage. If both the partners belong to the same religion, they do not have to follow this step.
  2. Traditional Marriage – If both the partners belong to the same religion, they will perform their marriage as per their religion. Hindus will perform Arya Samaj Marriage. Muslims will perform Nikah. Christians will perform Church Marriage.
  3. Marriage Registration – After the traditional marriage of partners as per the Vedic rituals, their marriage will be registered in court/ BMC / Mantralaya. It is performed in the presence of a marriage registrar & witnesses.
