BREACH OF CONTRACT
- A contract is said to be breached or broken when either of the parties fail or refuse to perform its promise under the Agreement. Breach of contract is a legal cause of action in which a binding agreement is not honored by one or more parties by non-performance of its obligation by him renders it impossible.
- Consequences: Chapter VI (Section 73 to 75) of the Indian Contract Act,1872 deals with the consequences of breach of the contract.
Compensation For Loss:
When a contract is breached, the party who suffers breach receives, from the party who has broken the contract, the compensation for any loss or damage caused to him ,which naturally arose or which the parties were aware of, when they made the contract, to be likely to result from the breach of it.
No compensation shall be given to any remote and indirect loss or damage sustained by reason of breach.
