I recently came across a video from on your firm on mutual consent divorce timelines and it says it can be done within a month. My query is if we want to file a divorce and all our matters are settled, there is no property dispute, no alimony, no child. We have been married for 5 years but have been facing challenges from last few years. How soon can the divorce be finalised?
If both spouses agree to divorce and there are no disputes regarding property, alimony, maintenance, or children, you may file a petition for mutual consent divorce under Section 13B of the Hindu Marriage Act, 1955. Ordinarily, there is a six-month cooling-off period between the first and second motions. However, based on the principles laid down by the Supreme Court, the Family Court may waive this period if you have been living separately, all issues have been genuinely settled, and there is no possibility of reconciliation. In such cases, depending on the court's workload and the facts of the case, the divorce may be finalized within approximately 1 to 2 months.
