Sir, could someone kindly clarify: I have been working as a clerk at a rural bank since 2017. I was directly recruited through IBPS at that time. Now, in 2024, I have been selected as a clerk in the railways under direct recruitment, and I want to join the railways. I had taken an NOC from the bank for the exam, and I’ve informed the railways that I was already employed elsewhere and am resigning from the bank through proper channels to join the railways. Am I eligible for pay protection? Can I claim my gratuity from the previous organization, or will the gratuity be transferred?
You are eligible for pay protection if the terms of your transfer from the bank to the railways allow it. As for gratuity, it typically cannot be transferred directly, but you can claim it from your previous employer. The bank should process your gratuity upon your resignation, but consult an expert to ensure proper handling. For further legal assistance contact us on our helpline number.
