I am a Hindu male from a community that does not allow cousin marriages. Can I legally marry my paternal second cousin (i.e., my father's first cousin's daughter)? I understand such marriages are prohibited under the Hindu Marriage Act due to being sapinda relations. But is it legally allowed under the Special Marriage Act, 1954, since second cousins are not on the list of prohibited degrees of relationship? Kindly refer to the Law Commission’s 212th Report – https://indiankanoon.org/doc/196490855/
Under the Special Marriage Act, you can legally marry your paternal second cousin if she is not within the prohibited degrees of relationship under that law. Sapinda rules of Hindu Marriage Act do not apply here. But make sure there's no local custom or specific objection in your family or region.
