There are two adjacent plots. Initially, both had separate sale deeds. The current owner purchased them from one family and combined them into a single sale deed. Now, the owner is trying to resell the plots separately. Issue: In the sale deed, all vendors' names are mentioned in serial order. However, for the plot I want to buy, the typist made an error and mentioned the wrong vendor number on page 3. As a result, the actual owner’s name is not correctly shown against the plot I wish to purchase. Now the seller is saying that a rectification deed is not possible because the original owners are no longer in contact, as the sale deed was executed in 2006. What should I do?
You should ask the current owner to execute a rectification deed to correct the error. If the original vendors can't be traced, get an indemnity bond signed and include a legal clause in your agreement to protect your ownership.
