How to file cheque bounce case for unreturned construction loan?
I gave money to a person to construct a house, and after completing the house, he refused to return the amount. At the time of payment, I took a cheque from him, but there were no funds in his account. I want to file a cheque bounce case to recover my money. Please guide me on how to make my case stronger and what steps I need to take legally.
You can file a cheque bounce case under Section 138 of the Negotiable Instruments Act within 30 days of receiving the return memo. Send a legal notice to the person within 15 days. To make your case strong, keep any proof of payment, construction agreement, or communication showing the loan was for house construction.
