Can neighbors file notice for bike parking on shared road?
We and our neighbors share a 14-foot-wide combined road. To exit the area, they must pass in front of our house. Using this as an excuse, they have been causing nuisance and harassment by bringing children from other colonies to gather near our gate. They even manhandled us, for which we filed a criminal case last year. In retaliation, they have made false allegations and lodged a fake FIR against us, claiming we blocked the road by parking our bikes in front of our gate—even though a bike cannot block a 14-foot-wide road. They have now issued a notice to us under Section 480 CPC. What should we do in response?
You should give a written reply to the notice clearly stating that your bike doesn’t block the 14-foot road. Their FIR is false and seems like a revenge act. Since you already filed a complaint for manhandling, keep that as proof. If they continue harassing you, file a complaint for nuisance and ask the court for protection.
