What should I do if panchayat ignores encroachment and disturbances?
I am from Bhajpur village, district Sakti, Chhattisgarh, 495692. In my gram panchayat, many people are encroaching on government property. A family is constructing a building in front of our house, which faces the main gate of the village (south-facing). The problem is that it is an alcoholic beverage selling point, and it causes traffic and disturbances due to drunk individuals, which negatively impacts the village environment. I raised this issue with the panchayat members, including the sarpanch, but they have not taken any action. I hired an advocate, but I feel he is not responsive and hasn’t clearly informed me about the case. Can you please suggest what I should do next?
Dear sir, Steps that you can follow : 1. Document the encroachment and disturbances by means of photographs and videos. Then collect witness statements from other villagers affected by the disturbances. 2.Submit a detailed complaint to the gram panchayat, including the sarpanch, and request immediate action. Approach the local police in case there is no valid action that is being taken. 3. File a civil suit under the Specific Relief Act to seek an injunction against the construction if it is causing public nuisance. If there are threats or trespassing involved in the said senario, file complaints under relevant sections of the IPC, such as Section 506 for criminal intimidation or Section 441 for trespass. 5. Make sure that your advocate is actively pursuing your case.
