Can I get refund and compensation from consumer court?
I subscribed to the Impact Plus lead generation package from Sulekha by paying ₹35,000 based on representations made by their sales representative. I was informed that the Impact plan generates approximately 3 leads per day and was advised that Impact Plus would provide higher and better-quality leads. Relying on this, I purchased the plan. However, the actual performance has been extremely poor, with only one lead in 4–5 days, most of which are non-responsive and not genuine, resulting in no business benefit. My refund request was denied, citing terms and conditions, despite clear misrepresentation and deficiency in service. I raised complaints with the company and also approached the National Consumer Helpline, but no resolution was provided. I seek legal advice on pursuing a refund, compensation, and litigation costs under consumer law for unfair trade practice and deficiency in service. Can I get a refund, compensation, and litigation costs through the Consumer Court? Please suggest.
You can file a complaint before the District Consumer Commission under the Consumer Protection Act, 2019 for refund, compensation, and litigation costs. If the company made false promises about lead generation and actual service is poor, it amounts to deficiency in service and unfair trade practice. Keep all proofs like payment, chats, and emails to support your claim. Consumer Court can grant relief. For further legal assistance contact us on our helpline number.
