How to claim Insurance for bike theft?
My newly purchased bike (worth ₹3.5 lakh) was stolen when an unknown individual snatched the keys and fled with the bike. I immediately lodged an FIR, and the police registered a theft case under BNS Section 303. At the same time, I informed the insurance company and filed my claim within the prescribed period. During the investigation, it was discovered that the motorcycle abandoned by the thief was also stolen. In both previous theft incidents, the thief had taken the keys from the owners on the pretext of a “test drive” and escaped. The surveyor is suggesting that I may have voluntarily handed over the keys, which is incorrect. The surveyor has also questioned whether the incident amounts to robbery instead of theft, since force was allegedly used. I seek legal guidance on protecting my insurance claim, responding to the surveyor’s assumptions, and understanding my legal remedies if the claim is unfairly rejected or delayed.
You should immediately submit a detailed written reply to the surveyor denying that you voluntarily handed over the keys and clearly explain that the bike was taken by force/snatching. Preserve FIR copy, claim documents, CCTV footage, witnesses, and police investigation records. Since the FIR and police investigation support theft/snatching, the insurance company cannot reject the claim merely on assumptions. If the claim is unfairly delayed or rejected, you can file a complaint before the Consumer Commission for deficiency in service and unfair claim handling.
