Dear Client, The Magistrate evaluates both the validity of the police arrest and the subsequent detention process when he assesses judicial remand according to Section 187 of the Bharatiya Nagarik Suraksha Sanhita 2023. The Magistrate has power to order police misconduct investigation through Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita 2023 which functions similarly to Section 156(3) CrPC. The law allows authorities to issue necessary instructions for investigation of both non-cognizable offences and cognizable offences according to Section 174 process. Public servants who commit record falsification will attract punishment under Section 218 of the Bharatiya Nyaya Sanhita 2023.

Dear client, The magistrate can refuse remand and may order for inquiry if the court finds that the police had acted wrongly in asking for judicial remand.
