Can you file for divorce if husband hid pre-marital relationship?

My husband stayed with a girl in a hotel before our marriage. He tried very hard to hide it. At first, he said that he did not know her, and later he said that he only stayed with her but that nothing happened. That girl’s life is also affected now. I am unable to trust him anymore. One by one, my husband’s photos with that girl in the hotel room and the hotel bill are coming out. My children may suffer in the future. His friend, even after knowing that my husband stayed with that girl, is supporting him. I do not want to continue this marriage. Please help.

Dear client, The Hindu Marriage Act 1955 Section 13 1 ia allows you to seek a divorce if you wish to end your marriage because your spouse has committed cruelty by hiding information and embracing a form of behaviour which resulted in mental suffering and the loss of trust. The faster divorce process through mutual consent allows both the parties to obtain their divorce through Section 13B. You have the right to get maintenance for you and your children under Section 144 of Bharatiya nagarik suraksha sanhita 2023. The evidence comprising relevant photographs & bills & communications becomes admissible under Bharatiya Sakshya Adhiniyam 2023 Makeru Sections 61 & 63. If you have any query please feel free to contact us.

If your husband hid a serious pre-marital relationship / hotel stay and you feel the marriage was based on concealment, fraud, or mental cruelty, you may consult a lawyer for divorce or, depending on facts, annulment if there was material concealment affecting free consent. Under the Hindu Marriage Act, 1955, you may seek divorce on the ground of cruelty under Section 13(1)(ia) if his conduct has caused serious mental trauma. If you have children, you can also claim maintenance, child support, residence rights, and seek custody orders. Keep all photos, hotel bills, chats, and admissions safely as evidence before taking legal action. For further legal assistance contact us on our helpline number.
