How can I get a divorce on the grounds of cruelty?
My husband, Divij, stayed with another girl in a hotel room before our marriage. At first, he said that he did not know her. Later, he said they were just friends. After some photographs were leaked, he claimed that he stayed in the hotel room with her only as a friend. He is not telling the truth and is hiding facts. He has also been involved with multiple girls, namely Rene, Nikhila, and Nandini. I want a divorce. This marriage is not working, and he appears to be trying to cover up his mistakes.
Dear client, If your husband hides facts from you lies to you many times or has relationships with other women that hurt your trust in him you might think about getting a divorce because of cruelty. This can be under Section 13 of the Hindu Marriage Act 1955 if you are in a Hindu marriage. Just having relationships before marriage does not automatically make your marriage invalid. But if your husband deceives you is mentally cruel and continues to misbehave after marriage these can be reasons for a divorce. Make sure you keep evidence, like photos, chats, hotel bills and messages. If you have any query please feel free to contact us.
If your husband hid important facts, lied repeatedly, or was involved in other women in a way that affects marital trust, you may consider filing for divorce on grounds of cruelty under Section 13, Hindu Marriage Act, 1955 (if Hindu marriage). Pre-marriage affairs alone do not automatically make marriage void, but deception, mental cruelty, and continued misconduct after marriage can support divorce. Keep photos, chats, hotel proof, and messages as evidence. For further legal assistance contact us on our helpline number.
