How can we get out of a false 498A case?
A divorce and maintenance case is ongoing between my brother and his wife. She stayed with us for only 2 months. After 7 years of marriage, she filed a 498A case against me and my mother. They had a fight after 4 months of marriage, and my brother ran away after he found out she was pregnant. Since then, he has only been in touch by phone. He attended 2 court sessions but refuses to continue. How can my mom and I get out of the false 498A case? My brother is threatening to commit suicide if we attend the case and defend ourselves. He says if we try to save ourselves, he will write a letter to the court claiming we forced the marriage and are responsible, etc. Please advise. My mom and son are both very sick, and I have to earn and take care of my family. I was never involved in their marriage and do not want to be now. How should we solve this? Please help.
You should consult a lawyer to file for quashing of the false case. Gather evidence to prove your innocence. In cases of threats, approach the police for protection. Your brother's threat is emotional blackmail, and the court cannot be influenced by such tactics. For further legal assistance contact us on our helpline number.
