How to get legal aid in domestic violence?
My wife, Shaheen Bano, is a domestic violence victim in Barabanki, Uttar Pradesh. The incident took place on 02.08.2025. A criminal case is already pending in the Barabanki court under BNS Section 173. We urgently need help for filing a Domestic Violence Act application under Section 12 for a residence order. The situation is critical: • More than 10 private advocates in Barabanki have refused to take the DV Act case • DLSA refused assistance, stating that the sections are not applicable (which appears to be legally incorrect) • My wife personally approached DLSA, but they still refused help • She is exhausted and currently staying at her sister’s place, as the matrimonial home is unsafe • We cannot afford high legal fees Is there any NGO-backed advocate or low-cost legal assistance available who can urgently file a DV Act application from outside Barabanki? This is an emergency.
Your wife can immediately file an application under Section 12 of the Domestic Violence Act, 2005 before the Judicial Magistrate in Barabanki or where she is currently residing. She can also seek Section 17 (right to residence) and Section 19 (residence order) for urgent protection. If local advocates are refusing, she can approach the District Legal Services Authority (DLSA) again with written complaint or directly move High Court under emergency writ jurisdiction for protection and legal aid direction. NGOs and legal aid clinics are also bound to provide assistance free of cost under Legal Services Authorities Act, 1987. . For further legal assistance contact us on our helpline number.
