What is status after nullity of first marriage?

After a marriage is dissolved by a decree of nullity under Section 12 of the Hindu Marriage Act, what will be the marital status of both parties if it was their first marriage? Will they be able to change their marital status back to 'single', or will it be considered 'divorced'?

A decree of nullity means the marriage is void or invalid from the beginning. So, legally both parties are considered ‘single’ again, not ‘divorced’. You can update your marital status in official records as "single" after the decree. For further legal assistance contact us on our helpline number.
