What should I do now regarding my ongoing legal cases?
I am a Hindu, unemployed (due to job loss), and have lost all my property (Rs. 17 lakhs). I have no income, while my wife is a government medical doctor with significant properties. My wife has filed 4 cases: (1) An FIR under Sections 498A, 406, 315 of IPC, and Sections 3/4 of the Dowry Prohibition Act (no chargesheet filed, bail granted), (2) A complaint under Sections 12 and 23 of the Protection of Women from Domestic Violence Act, 2005 (interim order for Rs. 4000 PM for a 3-year-old child), (3) A maintenance case under Section 125 of the Code of Criminal Procedure, 1973, (4) A Miscellaneous Execution case under Sections 12 and 23 of the Domestic Violence Act (payments made for the last 9 months). I have filed two cases: (1) A complaint under Section 200 of the Code of Criminal Procedure, and (2) A matrimonial suit under Section 27 of the Special Marriage Act, 1954. The court has sent matrimonial notices to my wife twice, but she has not received them. What should I do now, and what does my future look like? Please suggest.
Sir, to handle your situation, first, follow up with the court about the failed delivery of the matrimonial notice and request an alternative way to serve it. You can also ask the court to reconsider the maintenance amount, considering your financial condition. Keep defending the cases related to domestic violence and maintenance by providing evidence of your lack of income. Consider mediation to resolve issues outside of court. It’s essential to consult a lawyer to guide you through the process and protect your interests. For further legal assistance contact us on our helpline number.
