Can employees claim dues for unpaid additional work responsibilities?
I have worked as a Billing Engineer for approximately three years. In addition to my designated role, I was assigned QA/QC responsibilities on multiple projects, including TTDCL Tripura and Dahod, Gujarat, without any additional compensation. I also worked on Sundays, public holidays, and weekly off days. Despite these additional responsibilities, my salary increments were minimal. I submitted my resignation in January 2026, but my employer requested that I withdraw it and assured me that my salary would be increased. Relying on that assurance, I continued working. However, even after three months, no salary increment was granted. In these circumstances, what legal remedies are available regarding my salary, final settlement, and the employer's unfulfilled promise of a salary increase?
Dear Client, you can claim any unpaid salary, final settlement dues, leave encashment reimbursements, and other contractual benefits from your employer. But doing more QA/QC responsibilities, like additional checks and reviews doesn’t, by itself, turn into a legal right for extra pay unless it was really agreed upon in your contract, company policy, or some separate arrangement. The employer’s promise about a salary increase could help your case if you can show you actually relied on it and still kept working. Please send a written demand notice for your dues, and if it remains unresolved, you may consider approaching the Labour Authority or a competent court. Thank you for reaching Prime Legal.
If your employer assigned additional duties without compensation and promised a salary increase that was never granted, you may raise a formal written grievance and seek payment of any pending salary or settlement dues. Preserve emails, messages, resignation records, and proof of additional work. If lawful dues remain unpaid, you may approach the appropriate Labour Authority or take legal action for recovery of employment-related dues.
