Is Nikah valid without parents consent?
I am a Muslim girl, and she is also Muslim. We are both from Jharkhand. We want to get married. I want to ask whether our Nikah is valid without our parents' consent, or how we can perform our Nikah and register our marriage on the same day. Kindly help me.
In India, an adult Muslim couple's Nikah is valid without parental consent, provided both are 18+ (female) and 21+ (male), overriding personal law's puberty age due to the Prohibition of Child Marriage Act, 2006. Courts uphold adult's right to marry under Article 21. While the religious Nikah ceremony and Nikahnama issuance can occur same-day, official government registration under the Jharkhand Marriage Registration Act, 2017, typically takes 7-15 days after application via the Marriage Registration Office or Jharsewa portal, requiring various documents. The Special Marriage Act, 1954, also prevents same-day registration due to its 30-day notice period.
As per Muslim law, you can have a valid Nikah without your parents’ consent if you are of legal age (usually 18). The Nikah must be performed in front of two adult Muslim witnesses with a proper marriage contract (Nikahnama) by a Kazi Sahib in the mosque. After that, you need to apply for marriage registration at the SDM court, which usually takes about 30 days to complete. For further legal assistance contact us on our helpline number.
