What can I do if my wife misbehaves with me?
Sir, I got married on 23rd June 2022. Since then, my wife doesn’t talk to me or live with me properly. She visited my home only three times and never returned. Her family forces her to study and won’t even share her Aadhaar card with me. They ask me for money for her education. I found out she had a past love affair and her behavior is inappropriate—she posts videos in revealing clothes on Instagram and keeps all my brothers and others in her “following” list. She insults me everywhere and uses informal, disrespectful language. Now she says she wants a divorce, but her father keeps changing his statements. I am ready to separate and leave her. I can leave my family, but I don’t want to keep her anymore. Please help me legally.
Dear Client, You may proceed for divorce under Section 13 of the Hindu Marriage Act, and cite mental cruelty along with desertion, plus her refusal to live together, or cohabit. Her steady absence, as in practically no return, will be treated as desertion which continues well beyond two years. Before that, you can seek restitution of conjugal rights under Section 9 first, so the court record is properly established. Her improper behavior and the family’s meddling will help strengthen your case, even if it feels messy in practice. Since she is already asking for a divorce, a mutual consent divorce under Section 13B is usually the quickest way to reach a resolution. Please consult an advocate immediately to start the proceedings. Thank you for reaching out to Prime Legal.
You can file for divorce based on mental cruelty and abandonment. If your wife is not living with you and disrespects you and your family, you have strong grounds. Speak to a family lawyer to start divorce proceedings. Don’t send money unless legally required. Keep all records and messages safe. For further legal assistance contact us on our helpline number.
