Judicial Separation

 

(i) Anyone who wants to separate has to file a petition. A marriage solemnized before this Act or after that Act, requires the petitioner to find grounds under any of the sub-sections on which they shall file for separation of section 13(1).

 

(ii) In the case where the separation is passed by the court, the petitioner doesn't have to live together with the partner. But the court can make the couple stay together in a case where it is reasonable to do so.
