Section 2 - Application Of Act

This act applies to -

 

i) Those who are Hindus have chosen Hinduism which includes followers of Virashaiva, Lingayat, Brahmo, Prarthana, and Arya Samaj.

 

ii) People of India who come under Buddhist, Jain, or Sikh.

 

iii) For those who are not Christians, Muslims, Parsis, or Jews. Unless they can say that the religion or customs they are following are not governed under Hindu law. 

 

Specifications

In such cases, the following persons are Hindu, Buddhist, Jain, or Sikh by religion -

 

i) Any child legitimate or illegitimate whose parents are Hindu, Sikh, Buddhist, or Jain.

 

ii) Any children legitimate or illegitimate whose parents are Hindu, Sikh, Buddhist, or Jain. But they are raised as part of a tribe and community.

 

iii) People who are converted Hindu, Buddhist, Jains, or Sikhs.

 

a) This Act shall not apply to the members of the Scheduled Tribes within the meaning of clause (25) of Article 366 of the Constitution.  Unless there is an official notification by the Central Government in the Official Gazette.

 

b) Part of this Act should include the word Hindu as a reference to a person who is a Hindu by religion.
