Permanent Alimony & Maintenance

 

It states that -

 

1) If either husband or wife claims for the alimony or maintenance fees, the court has the power to pass the order for the payment of maintenance till the life of the applicant. 

 

The court may pass the order on the basis of income & property of the respondent as well as the parties, the conduct of the parties & other situations of the case. The applicants can pay the alimony or maintenance monthly or, periodically. 

 

2) After passing the order under sub-section (1), if there is a change in circumstances & the court is satisfied, any of the parties can modify or revoke the order in such a manner as the court considers it fit.

 

3) If the court is satisfied that in a case where the person getting the alimony has re-married and in the case where the respondent is wife, this states the change in the lifestyle of the wife and now the maintenance can be stopped or the court can modify the order.
