How to perform inter religion marriage?
My name is Irfan Ansari. I am 26 years old and I belong to Bihar. My partner belongs to the Hindu religion and she is 23 years old. We both are from Bihar. My family agrees to our marriage, but her family is totally opposed to it. We want to have a safe marriage. How can we do it? We are afraid that her family may harm us if we leave our homes and they find us. I want to know the proper legal process. Can we apply for marriage registration online and then appear before the Marriage Registrar only on the scheduled date for registration?
Dear Client, You can solemnize an interfaith marriage under Section 4 of the Special Marriage Act, 1954, which requires a 30-day prior notice under Section 5 to the Marriage Officer, followeding publication and objections procedure under Sections 6 to 7 and appearance for solemnization under Section 11. The online application process requires users to complete the initial step, but they must come to the office to finish their registration. You can request police protection if you feel threatened and you can file a petition in the High Court according to Article 226 of the Constitution of India.
Since both of you are majors, you can legally marry by free consent. For an interfaith marriage, the Special Marriage Act, 1954 applies, which usually requires 30 days’ notice period. Same-day marriage registration is generally not possible. If there is a threat, seek police protection or file a writ petition under Article 226 for safety before proceeding.
