How to legally recover your money?

Hi, I gave money to my college friend, and he promised to return it within one month. However, it has been more than three years, and he has not returned anything. He always gives the excuse that he has no money. He is living in Pune and was earlier paying rent of ₹40,000, and last year he upgraded to a new apartment where the rent is ₹54,000. I also came to know from a common friend that he has not returned money to him either. I have a complete money trail, as I transferred the money through bank transactions, and I also have WhatsApp chats, including a recent one. I want to file a criminal FIR. Since his son lives in the US and his daughter in the UK, I believe that if a criminal case/FIR is filed, it may affect his ability to renew visas, and he may then return my money. I also want to file an FIR along with a civil summary suit. Please advise.

Since you have bank transfer records and WhatsApp chats, first send a legal notice demanding repayment within a fixed time. If it can be shown that he took money with a dishonest intention from the beginning, you may file a complaint for cheating or criminal breach of trust. Also file a civil recovery case / summary suit for money recovery. Use criminal action only if supported by strong evidence, not just to create pressure.
