Can I withdraw 498A and file police complaint instead?

I have filed three cases against my husband under Sections 12 DV, 498A, and 125 CrPC in court. It has been one year, but no summons have been issued in the 498A case. Can I withdraw the 498A case and instead file a complaint with the police? Which option is more beneficial for me?

Yes, you can withdraw the 498A case filed in court and lodge a fresh complaint directly with the police if you feel that will bring faster action. However, withdrawing needs court permission. Consult your lawyer on whether evidence is strong enough to go through police or court. Choose the option where you feel safer and heard.
