You are in a very complicated situation, emotionally, legally, and ethically speaking. Legally, if she has taken advantage of you through lying to you that you were married, then she comes within Section 69 of the Bharatiya Nyaya Sanhita, which provides for criminal sexual intercourse on the basis of fraudulent promise. That law takes into account the fact that the punishment can be quite grave, even to ten years of imprisonment. Consider documenting all communications with her and seek legal advice to explore your options. Engaging in an extramarital affair is risky and may complicate your situation further. Prioritize your well-being and legal rights moving forward.

In your case, you may have a cause of action in law under the principles governing false promises of marriage. Since she has taken sexual and monetary benefits on the pretext of marriage but refused to marry, you could consider bringing a complaint for sexual exploitation under Section 69 of the Bharatiya Nyaya Sanhita, criminalizing sexual intercourse based on deceitful means, including false promises of marriage. However, you should collect evidence that indicates her intentions and your corresponding communications. Consult a family law attorney so as to find the right options to protect your rights.

It's completely understandable to feel hurt, betrayed, and confused. If you can prove that the woman made false or misleading statements about her intentions to marry you in order to obtain sexual or monetary benefits, you may be able to take legal action for fraud.
