What should we write in Section 313 about documentary evidence?
In a 498A, 323, 504, 506 IPC, 3/4 DP Act, and DV case where the prosecution has closed evidence, what should we write in Section 313 about the evidence? The petitioner admitted many pieces of evidence with "if" and "but." I have documentary evidence like photographs, medical treatment papers, bills, a gift deed from my mother to her, bank statements of money transferred from my husband’s account to my wife’s account, etc. Please advise specifically for 409A and DV cases. Should the accused give a statement and documentary evidence under oath and appear for cross-examination before the documentary evidence is read and admitted by the court? Or: Can we submit documentary evidence with a List of Documents without an oath? Will the court read and admit our documentary evidence? If we file documentary evidence with a List of Documents, can the prosecution demand cross-examination?
In Section 313, the accused must respond to the charges and evidence. If you have documentary evidence, submit it with the list of documents. If the prosecution requests cross-examination, you must comply. The court may consider the documentary evidence after verifying it through the examination.
