Can I challenge seniority list?
In 2011, UPPSC issued a notification for 180 Assistant Engineer (AE) posts through direct recruitment. Again in 2013, another notification was issued for 640 AE posts in the Irrigation Department. The final result for 2011 was declared in May 2016. However, in 2016, UPPSC also released a list of 200 promoted AEs. The department gave joining to promotion quota candidates first, then released the 2011 direct recruitment list. Further promotion lists were issued through various orders. The 2013 AE result was declared in May 2019, but before joining (on 18.11.2019), a list of 80 AEs was released for promotion. Finally, on 21.11.2019, the 2013 AE joining list was issued. As per the Group B Uttar Pradesh service rules, no new advertisement should be issued before completing a previous recruitment. I am a selected candidate of the 2013 direct AE recruitment. Why am I placed lowest in the seniority list, even though the promotion quotas are from 2015 onwards?
You can challenge the seniority list by filing a writ petition in the High Court. Since the recruitment rules were violated and promotions were adjusted improperly before your joining, you can ask the court to revise the seniority list.
