How can I legally recover my salary?
I left the company on 21 February 2026 without serving the notice period. My salary has not yet been settled. I have asked the company to pay it, but they are saying that I have to pay 40% of the salary received during the last five months, and only then will I get my pending salary. I need legal guidance to recover my salary.
Your company cannot legally withhold your salary without valid reason. Notice period recovery or penalty must be clearly mentioned in your appointment letter or employment contract. Even if you left without notice, they must pay earned salary after lawful deductions. You can send a legal notice, file complaint with Labour Commissioner, and approach labour court for recovery of pending salary. For further legal assistance contact us on our helpline number.
