Who can sign a gift deed for NRO account transfer?
Hi, I am an NRI living outside India. My mother, an Indian resident, wants to gift me some money, which she will deposit into my NRO account. I intend to remit this money abroad. The bank requires a gift deed as proof of the source of funds. Since I am not in India, I have some questions: Can the gift deed be prepared after the money is transferred, provided I get the stamp paper issued before or on the transfer date? Does the donor and donee need to sign together, or can the donor sign first and I sign later in India? Can my Power of Attorney (PoA) in India sign the gift deed on my behalf?
The gift deed can be signed after the transfer if the stamp paper was issued before. Both donor and donee do not need to sign together; the donor can sign first, and you can sign later in India. Your PoA can’t sign on your behalf; you must sign personally. For further legal assistance contact us on our helpline number.
