What legal action can be taken if builder sold staircase area without sale deed: ?

A builder (now deceased) sold the common staircase area as a shop to my father (also deceased) in 1986, promising to make changes to the building plan and provide a sale deed. However, he failed to fulfill this promise. What should I do now? I need to regularize my shop and have its sale deed created.
