Section 23(a) Of Hindu Marriage Act, 1955
In case of proceedings for divorce or, judicial separation or, restitution of conjugal rights -
- The respondent can oppose as well as counter-claim for any relief on the grounds of adultery, desertion, or cruelty.
- If the adultery, cruelty, or abandonment of the petitioner is proved, the Court may grant to the defendant any relief under this Act. ( If he had presented a petition seeking such relief on that ground ).
