What is the procedure to release a seized car without arrest?

The police registered an FIR under sections 279 and 338. They did not arrest the accused but seized the car. My question is: Is it mandatory to take bail from the court in order to release the car?

Dear client, no, taking bail is not mandatory for release of the seized car. You can file an application for release of the vehicle before the magistrate with RC insurance and ID proof. The court in this issue may release the vehicle on bond or undertaking even if no arrest has been made. May this help and if you have any further issues do not hesitate to contact us.

No, it is not mandatory to take bail for the release of the car in this case. Since the car was seized, you can file a petition in the court for its release. Bail is usually required for individuals, not for property. Seek legal advice to speed up the process. For further legal assistance contact us on our helpline number.
