How can I legally claim pending dues from employer?

I am writing to seek your expert guidance regarding an issue I’m facing with my previous employer, who has not provided my full and final settlement. I resigned from my position on 30th September 2023, after serving the full notice period. However, it has been over 90 days since my resignation, and I have still not received my full and final dues. Despite following up with the HR department, their responses have been inadequate. Could you please guide me on the proper legal procedure to obtain my settlement? Also, what legal actions can I take if they continue to neglect their obligation? I worked in Chennai, Tamil Nadu, while the company's head office is in Bangalore, Karnataka.

Send a formal written notice to your company demanding settlement. If they don’t respond, file a complaint with the Labour Commissioner in Chennai or Bangalore. You can also approach a labour court. Keep all emails and records—those are your proof. You are legally entitled to your dues. For further legal assistance contact us on our helpline number.
