What legal action can be taken against delay in OBC certificate?
I am Shaik Abdul Mujeeb, and I originally belong to the OBC category (Muslim Butchers) in Andhra Pradesh. However, I was not initially issued an OBC certificate because my surname “Shaik” was treated as indicative of a community falling under the General category, and the authorities instead issued me an EWS certificate. I later collected supporting material to establish that a surname does not determine caste, and eventually the authorities issued me an OBC certificate. In the past, I had applied for UPSC examinations under the EWS category. After receiving my OBC certificate, I applied under the OBC category. UPSC is now questioning this change. How should I proceed further?
Dear client, If you truly qualify for the OBC category and subsequently receive an authentic OBC certificate, the transition from EWS to OBC can be justified. Provide a comprehensive written submission to UPSC along with your OBC certificate, previous EWS certificate, caste documentation, and a thorough clarification indicating that the prior EWS claim resulted from the absence of the OBC certificate at that time. If UPSC unjustly denies it, you can appeal the decision at the Central Administrative Tribunal (CAT) If you have any query please feel free to contact us.
If you genuinely belong to the OBC category and later obtained a valid OBC certificate, the change from EWS to OBC can be explained. Submit a detailed written representation to UPSC with your OBC certificate, old EWS certificate, caste proof, and a clear explanation that the earlier EWS claim was due to non-issuance of the OBC certificate at that time. If UPSC rejects it unfairly, you may challenge the decision before the Central Administrative Tribunal (CAT). For further legal assistance contact us on our helpline number.
