What legal action can I take for unpaid PF and salary?

My company has not submitted my PF to EPFO for the last 6 months, my TDS to the government for the last 6 months, and my salary for the last 2 months (January and February 2024). Despite informing HR and the director multiple times, I have not received any significant response. As a result, I decided to withhold some money from customers, which I have not shared with the company, and I have informed them in writing that I will release the amount once these issues are resolved. Can you guide me on the legal aspects of this situation?

Your employer is legally obligated to pay your salary and contribute to your PF and TDS. If they fail to do so, you can send a legal notice demanding payment. If they continue to neglect their duties, you can file a complaint with the labor commissioner or approach the court for non-payment of dues.
