Is it legal for the college to withhold my documents?
The college is withholding my original documents, such as mark sheets, transfer certificates, SSLC, and Plus Two credentials, to pressure me into paying the fees. I was late in joining, and I informed them on the first day that I couldn't continue there. They tried to convince me to stay, but in the end, they told me that I have to pay the full fee amount to get my original certificates back.
Withholding original documents to pressure fee payment is illegal under UGC and AICTE guidelines. You can file a complaint with the college authorities, the education department, or approach the consumer court for the release of your documents. Sending a legal notice through a lawyer may also expedite the process.
According to Indian law and Supreme Court rulings, educational institutions cannot legally withhold original documents to force fee payment, as it violates fundamental rights and UGC guidelines. You can immediately file a complaint with the UGC (University Grants Commission) or send a legal notice to the college through a lawyer, citing that they can only charge fees for the period you actually attended. If the college still refuses, you can file a writ petition in the High Court under Article 226 of the Constitution of India.
