Can I sue architect for construction losses?
We are constructing a house, and cracks have appeared in the beams and columns. After a structural audit, we found that the TMT bars specified by our architect were significantly less than the required quantity, which caused the structural cracks. We spent ₹30 lakhs on repairs and may need another ₹30–40 lakhs to complete the civil work again. Can we take legal action against the architect to recover our losses? Should we file a case in court or lodge a complaint with the Council of Architecture? What are the chances of winning the case, how much compensation can we realistically recover, and is it advisable to accept the architect’s offer of ₹10 lakh compensation?
You can definitely take legal action. Since the structural audit proves that the architect used less TMT steel and caused major cracks, it is clear professional negligence. You can file a case in the Consumer Court to recover the full repair cost and compensation, and also complain to the Council of Architecture. Your chances are strong. The architect’s offer of ₹10 lakh is too low compared to your actual loss. For further legal assistance contact us on our helpline number.
