Should I amend the sale deed before selling the property?

I hope all is well. I have a query regarding a sale deed. I own a flat, and the sale deed includes both my name and my mother’s name. I am the only child of my parents. Since both my father and mother have unfortunately passed away, I need to know if I should register an amended sale deed with the registrar, removing my mother’s name, before selling the flat. Or will the current sale deed, along with her death certificate, suffice when selling the property?

Sir, you do not need to amend the sale deed to remove your mother’s name. The existing deed, along with your mother’s death certificate, should suffice when selling the flat. However, you must provide proof of being the sole legal heir, such as a legal heir certificate or succession certificate. These documents establish your right to sell the property. It's advisable to consult a property lawyer to ensure the process is smooth and legally sound. For further legal assistance contact us on our helpline number
