Maternity Benefit Act

I'm working as contractor in a Singapore based MNC. The offer letter I have is from Singapore and the salary mentioned in the contract is in INR. I'm working as a contractor from India. They dont provide form 16 or PF benefits. My employer is saying that I'm not eligible for maternity benefit because I'm in India and the offer letter is from Singapore. I would like to know, if I'm eligible for maternity benefits. NOTE: The Company has a presence in India and the offer letter says its a Subsidiary of the parent company which has presence in many countries including India and all the contractors follow India holiday calendar.

Ma’am, maternity leave is allowed in every sector including- employee working in mines, shops, MNC, factories, etc. No employer can reject or disagree for maternity leave as far as the organization is present in India. You can reach out to labour court; the labour court may take action against the employer with 3 months of imprisonment and fine. For further legal assistance contact us on our helpline number.
