Regarding experience certificate

I have worked with an organization now the employment contract over . The offered me office tab, ID card and sim card. I have handed over all the assests to respective office. They asked me an affidavit to issue the experience certificate. I have submitted my affidavit now but they are telling that it will take 30 days to issue my experience certificate. A new company selected me for a job and they are asking my experience certificate now so holded my offer letter. Is there any possibility to file a case against my previous company?

Sir, no employer can deny to issue relieving/experience letter to their employee who has resigned with proper procedure and has no dues. If your employer is doing so, it is an unjustified, illegal act and against the fundamental rights of the employee. You can issue a legal notice to your employer for the same.
