Yes, a cheque bounce case under Negotiable Instruments Act, 1881 and a summary suit under Order 37 CPC are separate legal remedies and can proceed together. Section 138 NI Act is a criminal proceeding for dishonoured cheque, while Order 37 CPC is a civil recovery suit for money recovery.
