Can I sue seller after knowingly buying illegal constructed property?
I knowingly purchased a house in an illegal construction project 8 years ago. The seller had even attached the Municipal Corporation’s illegal construction notice with the sale deed, which I signed. Can I still sue him?
Dear Client, Thank you for reaching out. We are happy to assist, though this matter is legally complex. If you knowingly purchased an illegally constructed property, your claim is significantly weakened. However, if the seller deliberately concealed or misrepresented the property's legal status, you may have valid grounds to sue for fraud and misrepresentation under contract law. You may seek rescission of the sale agreement along with recovery of the purchase amount and damages. Relief can be pursued before the Consumer Forum or Civil Court. That said, documented prior knowledge on your part would make your claim difficult to sustain. For further assistance, please contact Prime Legal.
If you knowingly purchased the property despite knowing about the illegal construction notice, your case may become weaker because the seller can claim proper disclosure was already made. However, you may still take legal action if the seller hid important facts, committed fraud, or gave false assurances. For further legal assistance contact us on our helpline number.
