Can Indian–Spanish marriage be registered under Hindu Marriage Act?
My son recently married a Spanish woman, and they have come to India on vacation. They wish to register their marriage and obtain a marriage certificate under the Hindu Marriage Act.
If the marriage was performed according to Hindu rites and ceremonies, it can be registered under the Hindu Marriage Act, 1955 by applying to the local Marriage Registrar where the marriage was solemnized or where either spouse resides. The foreign spouse will need a passport, visa, birth certificate, marital status affidavit, and police verification. If Hindu rituals were not performed, the marriage must be registered under the Special Marriage Act, 1954 instead. For further legal assistance contact us on our helpline number.
